In creating an understanding of Patients’ Rights within the healthcare system, healthcare systems create a structure of trust, accountability, and transparency between patients, providers, and the healthcare system.

Importance of Patients Rights 

Patients’ rights are the basis for ethical, transparent, and patient-centred delivery of care in medicine by providing patients protection from unethical actions (misconduct), negligence, and discrimination; promoting autonomy and informed decision-making by defining standards for dignity in treatment, confidentiality, and quality of care. It defines accountability for healthcare professionals and institutions of care delivery; enhances patient trust, which is a critical component of the therapeutic relationship, treatment adherence, and positive clinical outcomes. Establishing strict and enforceable patients’ rights provides for an equal opportunity for all people to receive care, regardless of socio-economic status, gender, or background, in an equitable environment that provides fair, respectful, and safe care.

Patients’ rights play an important role in the protection of the moral and legal integrity of healthcare systems, as well as improving overall patient safety and institutional credibility, and public confidence in medical services.

What Are the Available Patients’ Rights in India?

In India, patients have a comprehensive set of rights derived from the Constitution, health regulations, and the Health Ministry's Patients’ Rights Charter. These rights allow every patient to access safe, transparent, ethical, and dignified medical treatment. Furthermore, these rights allow patients to make informed choices, to have their private information protected, and to have the means to report complaints regarding their treatment and the treatment processes, as well as hold those providing patient care accountable.

1. Right to Informed Consent: By virtue of the right to informed consent, patients have the right to be fully informed of all aspects of a diagnosis and treatment plan so that they may make an educated, independent decision about treatment. Through academic discussions, informed consent has been acknowledged as the ethical basis of modern medical practices and reflects the respect of the individual for their personal autonomy and their right to make decisions about their own bodies.

2. Right to Privacy & Confidentiality: Confidentiality is an essential part of the physician-patient relationship. Protecting a patient's private information during diagnosis, treatment, and the post-treatment stage is necessary in order to maintain the trust between the physician and the patient. The ethical principles of healthcare practice, the data protection laws, and hospital policies in place to protect confidentiality reinforce the belief that privacy is both an ethical obligation and a legal obligation on behalf of the healthcare provider.

3. Quality & Safe Care Right: Patients have a right to receive competent, evidence-based and safe health services. The right includes the provision of timely access to all diagnostic tests, treatment interventions and emergency services by qualified practitioners. Having the right to quality care reduces health inequities, supports health equity, and provides healthcare providers with a clear expectation of how healthcare will be delivered according to established national and international clinical standards.

4. Dignity and Respect Right: The respect of human dignity is fundamental to the practice of medicine and is a basic tenet within the practice of medicine. As a result, health providers must provide appropriate care without discrimination, coercion or bias. In addition, this right includes communication that respects an individual's cultural background, values, and beliefs, and provides care in an environment where the patient receives compassionate treatment.

5. Right to Obtain Information and Transparency: Patients have the right to be informed of their hospital, treatment costs, prognosis and alternative options, and this information is required to support a patient's decision-making process, as well as to promote accountability on the part of healthcare organisations.

Patients’ rights guarantee that all persons who seek healthcare will receive safe, dignified, transparent, and equitable medical care. By maintaining patients’ rights, protecting informed consent, privacy, quality of care, and access to grievance redress, healthcare organisations build an environment of trust and safety for patients.
